Mark Solomon is torn between hiring his church colleague and a hardworking person who deserves a permanent position, or denying him the position based on falsified employment documents. The conflict in this case arises mainly from the conversation between Lupe Garza (Carmen Mendoza) and Sarah, the human resources staff. Sarah knowingly promised Lupe a permanent position at the factory. In doing so, Lupe turned down another job that had been offered to him because of the promise Sarah had made to him. Mark Solomon, who knows Lupe Garza by her real identity, is troubled by the revelation that she was working under a false identity and continues to widen the conflict. Although she is clearly qualified for the permanent position due to her immediate availability and skills, Mark disputes the legal implications of hiring her under a false identity. The additional revelation that there were more Mexicans working in the factory under assumed identities does not help Mark influence his decision-making. The stakeholders in this ethical dilemma are Lupe Garza, Sarah and Mark Solomon. By knowingly hiring individuals with full knowledge of their purchased identities, the company violated Code Section 1324a – Illegal Employment of Aliens. The employer, in this case the factory, failed to make the required good faith effort by verifying the social security numbers of each employee on the administration's website in the first case.
