The Supreme Court ruled in favor of the Fourteenth Amendment, equal protection under the law, and state bans on same-sex marriage in the United States, which same-sex marriage dissidents say would reduce their right to religious freedoms. The change in judgment between the Hobby Lobby case and the Obergefell v. Hodges increased the intensity of the conflict between the First and Fourteenth Amendments, reiterating that there is no resolution to the turmoil between the First and Fourteenth Amendments when Supreme Court opinions waver. According to David Savage, the author of Battles Over Religious Freedom Are Sure To Follow Same-Sex Marriage Rule, “[t]he close division among the justices almost guarantees that further legal battles lie ahead. This division reflects the inherent conflict between the First and Fourteenth Amendments. The Supreme Court, however, attempts to balance the conflict with an unsuspected outcome: the restoration of religious freedom.
